Scholz v. United States
Scholz was honorably discharged following her 2006-2008 Army tour of duty in Iraq but the mental and physical toll of her service continued. Scholz required a range of medical treatments. Scholz sought two courses of inpatient mental health treatment at the Tomah VA Medical Center in 2011. Later, while receiving outpatient mental health treatment through the Tomah VAMC, she consulted surgeons at the Zablocki VA Medical Center about elective breast reduction surgery. An unrelated psychological assessment performed at Zablocki VAMC raised concerns about Scholz’s mental health. Zablocki VAMC surgeons performed elective breast reduction surgery in 2012, igniting multiple complications. Scholz continued to receive outpatient mental health treatment, including prescription medications, from various VA providers through late 2018.Scholz has two lawsuits pending against the government under the Federal Tort Claims Act (FTCA), 28 U.S.C. 1346(b), 2671–2680. The government argued that the second suit on the same, or essentially the same, operative facts, was precluded on claim-splitting grounds. The Seventh Circuit affirmed the dismissal of the suit. Scholz’s theory amounts to “arbitrarily splitting the treatment timeline.” In both suits, she mentions her treatment for mental health issues, her breast reduction surgery, the unsafe prescribing of medications, and improper record handling. Ittersagen v. Advocate Health and Hospitals Corp.
Ittersagen brought a medical malpractice action against Advocate Medical and Dr. Thakadiyil, alleging that the defendants negligently failed to diagnose him with sepsis and treat him appropriately. A jury was sworn. More than halfway through the trial, the court received a note from a juror, who reported that he had a business relationship with “the Advocate Health Care System Endowment.” The juror, a partner in a company that handles investments, said he believed the endowment was affiliated with but separate from Advocate Medical. He explained that his connection to Advocate Medical was so attenuated that he forgot to mention it during jury selection. The juror insisted that the outcome of the trial would not affect him financially and that he could remain fair and impartial. The trial court denied Ittersagen’s request to remove the juror for actual bias or implied bias and to replace him with an alternate juror. The jury returned a verdict for the defendants.The appellate court and Illinois Supreme Court affirmed, rejecting an argument that the juror’s business relationship with the endowment created a presumption of bias that cannot be rebutted by claims of impartiality. The court noted the lack of evidence of the affiliation between the endowment and Advocate. The juror did not owe Advocate a fiduciary duty and did not have any other direct relationship with the defendants that would create a presumption of juror bias as a matter of law. Love v. United States
Vargas received extensive medical care from the Veterans Administration. In his suit under the Federal Tort Claims Act, 28 U.S.C. 2671–80, he argued that a VA nurse was negligent in failing to order additional tests after receiving the results of urinalysis in October 2015. More testing, Vargas contended, would have revealed that he suffered from a urinary tract infection; failure to diagnose that infection led to a heart attack, which led to extended hospitalization, which led to pain and inflammation.The Seventh Circuit affirmed the rejection of his claims, upholding the district judge’s decision to allow testimony from a board-certified urologist. Federal Rule of Evidence 702 governs the admissibility of expert evidence in suits under the FTCA. The district judge was entitled to consider the urologist’s view that the applicable standard of care did not require follow-up testing to look for a urinary tract infection. If even a board-certified urologist would not have seen anything in the test result calling for further lab work, then a nurse practitioner’s identical decision cannot be negligent. Mitchell v. Los Robles Regional Medical Center
Mitchell swallowed 60 Naproxen tablets. With her husband, she arrived at the Hospital emergency department on May 27, 2017, alert, oriented, and with no acute distress. The physician noted no motor deficits or sensory deficits. A nurse placed an IV catheter in Mitchell’s forearm. Nearly two hours later, Mitchell walked to the toilet with assistance from her husband, then walked back to her bed without assistance. On the way back, Mitchell fell, causing abrasions to her face and severely injuring her knee. The nursing staff had no reason to suspect Mitchell presented a high fall risk because she did not complain of dizziness; they had no observed balance problems. An x-ray and CT scan of Mitchell’s knee showed serious injuries. Mitchell was referred to physical therapy and was discharged from Hospital.Mitchell filed her complaint, alleging general negligence and premises liability on May 17, 2019. The hospital argued that the complaint alleged professional negligence, rather than general negligence or premises liability, and was barred under Code of Civil Procedure section 340.5’s one-year limitations period. Mitchell acknowledged that the condition of the floor did not contribute to her fall. The court of appeal affirmed the dismissal of the complaint. Titus v. Alaska, Department of Corrections, et al.
The personal representative of an estate brought a medical malpractice claim against a company that provided the decedent emergency room medical care shortly before his death. The superior court granted summary judgment dismissing the estate’s claim against the company, reasoning that the estate’s board-certified expert was not qualified to testify about the relevant standard of care. The Alaska Supreme Court reversed, finding the physician, licensed under AS 09.20.185(a)(1), met the requirement of AS 09.20.185(a)(3) because a variety of fields of medicine, directly related to the matter at issue. Brown v. Long Romero
The issue this case presented for the Colorado Supreme Court's review was whether the “McHaffie Rule” applied even where the plaintiff chooses not to assert vicarious liability for an employee’s negligence and, instead, asserts only direct negligence claims against the employer. Here, Erica Murphy Brown and Steven Brown (collectively, “Brown”) sued Denver Center for Birth and Wellness (“DCBW”) for negligence and negligent hiring. Brown also sued Shari Long Romero, a DCBW employee and certified nurse-midwife, for wrongful death. The suit arose from the death of Brown’s child during labor at DCBW. After acknowledging vicarious liability for Long Romero’s negligence - by admitting, in its Answer, that Long Romero’s alleged acts and omissions occurred within the course and scope of her employment - DCBW moved for partial judgment on the pleadings under C.R.C.P. 12(c) on Brown’s negligent hiring claim. The trial court, citing the McHaffie Rule, granted DCBW’s motion and dismissed Brown’s negligent hiring claim—even though Brown had chosen not to assert vicarious liability for Long Romero’s negligence. The Supreme Court held that a plaintiff’s direct negligence claims against an employer are not barred where the plaintiff does not assert vicarious liability for an employee’s negligence. Thus, the trial court erred in granting DCBW’s motion for partial judgment on the pleadings and dismissing Brown’s negligent hiring claim. Bednarski v. Johnson
Dr. Zenon Bednarski and his practice, Auburn Urgent Care, Inc. ("AUC"), appealed a circuit court judgment awarding Cortney Johnson ("Cortney"), as the administrator of the estate of Hope Johnson ("Hope"), deceased, $6.5 million. In October 2014, Hope and her mother visited Dr. Kerri Hensarling for evaluation and the prescription of a birth-control method. Hope's mother informed Dr. Hensarling that she had personally experienced multiple blood clots, and Dr. Hensarling ordered tests to determine if Hope was also at risk of experiencing blood clots. The test results revealed the presence of factor V Leiden, which contributes to the possibility of blood clotting. However, Dr. Hensarling failed to accurately determine the results of the test, and Hope and her mother were informed that the test results were negative for blood-clotting factors. Dr. Hensarling prescribed hormonal birth-control pills for Hope, the taking of which in combination with the presence of factor V Leiden would increase her risk of experiencing blood clots. Hope began taking the birth-control pills as prescribed, without knowledge of her increased risk for blood clots. In December 2014, Hope visited the AUC clinic, complaining of shortness of breath, chest pains, coughing, a headache, and a sore throat. Dr. Bednarski diagnosed Hope with bronchitis and prescribed an antibiotic medication. Hope returned to the AUC clinic a few days later, complaining of a much worsened condition, with sharp chest pains and extreme shortness of breath. A blood test was conducted, and Hope was diagnosed with leukocytosis and dyspnea and was prescribed an inhaler. The next morning, Hope died of a pulmonary blood clot. In May 2016, Hope's father, Cortney, as the administrator of her estate, filed suit, naming as defendants Dr. Hensarling and her practice, and Dr. Bendarski and AUC. Cortney settled with Dr. Hensarling; the Bednarski defendants unsuccessfully moved for a judgment as a matter of law at the close of Cortney's case-in-chief. The jury returned a general verdict in favor of Cortney against the Bednarski defendants. Finding that the Bednarski defendants failed to demonstrate they were entitled to a judgment as a matter of law, the Alabama Supreme Court affirmed the trial court. View "Bednarski v. Bittner v. Centurion of Vermont, LLC et al.
In an interlocutory appeal, defendants challenged the trial court’s denial of their motion to dismiss plaintiff’s medical malpractice claim. They contended dismissal was required because plaintiff did not file a certificate of merit (COM) with her complaint as required by 12 V.S.A. 1042(a) and the trial court did not find, nor did the complaint show, that this was a “rare instance” where expert testimony was unnecessary under section 1042(e). Ex parte Mobile Infirmary Association d/b/a J.L. Bedsole Rotary Rehabilitation Hospital and d/b/a Mobile Infirmary Medical Center.
Mobile Infirmary Association ("MIA"), doing business as J.L. Bedsole Rotary Rehabilitation Hospital ("Rotary Rehab") and doing business as Mobile Infirmary Medical Center ("Mobile Infirmary"), petitioned the Alabama Supreme Court for mandamus relief from a complaint filed by John McBride alleging medical malpractice. According to McBride's complaint, he had undergone a craniotomy, hospitalization, and treatment at Mobile Infirmary for a subdural hematoma he had suffered while at home. He alleged that, in early June 2018, he was transferred to Rotary Rehab "to receive skilled and specialized nursing, medical and rehabilitative therapy." McBride further alleged that, while he was a patient at Rotary Rehab, he "suffered a decubitus pressure ulcer to his left and right heels, causing severe pain and suffering, infection, hospital treatment, financial loss, emotional distress, and eventually amputation below his left knee." McBride's complaint asserted counts of negligence and wantonness against the defendants, based on several alleged breaches of the applicable standards of care. MIA, in its capacity doing business as Rotary Rehab and in its capacity doing business as Mobile Infirmary, moved to dismiss McBride's complaint, arguing that his claims are barred by the limitations period set out in 6-5-482(a), Ala. Code 1975. Specifically, MIA contended the complaint was not filed until July 22, 2020, more than two years after the date of accrual of any potential claims against Mobile Infirmary or Rotary Rehab. The Alabama Supreme Court determined the statutory bar was apparent from the face of McBride's complaint. Therefore, MIA demonstrated a clear legal right to an order dismissing the complaint. Accordingly, MIA's mandamus petition was granted, and the writ of mandamus was issued directing the circuit court to vacate its order denying MIA's motion to dismiss, and to enter an order granting the motion. Greenwood Leflore Hospital et al. v. Watson
Roxanne Watson filed two successive lawsuits against Greenwood Leflore Hospital and Dr. John Lucas III (collectively, “GLH”), alleging medical negligence. Watson’s first complaint was dismissed without prejudice because a notice of claim was not filed with the chief executive officer of the governmental entity at least ninety days before instituting suit as required by Mississippi Code Section 11-46-11(1) (Rev. 2019) of the Mississippi Tort Claims Act (MTCA). Watson then refiled the complaint. GLH sought dismissal of the second complaint, contending that Watson was required to provide it with a second notice of claim and that the one-year statute of limitations had expired. The trial court denied GLH’s motion to dismiss, and the Mississippi Supreme Court granted an interlocutory appeal. After review, the Supreme Court concluded Watson satisfied the MTCA’s notice requirements, affirming the trial court’s order denying the motion to dismiss. View "Greenwood Leflore Hospital et al. v.
